Terms of Service

The rules for using Botique as a merchant. Last updated: April 2026.

1. Agreement

By creating a Botique account you agree to these Terms of Service and our Privacy Policy. These terms govern your use of the Botique platform (“Service”) operated by Botique Ltd (“Botique”, “we”).

2. Your account

You are responsible for keeping your login credentials confidential and for all activity on your account. You must be at least 18 years old and legally able to enter a binding contract in your jurisdiction. You confirm that any business information you submit is accurate.

3. What Botique provides

Botique gives merchants a hosted storefront, AI chat assistant integrations with Meta (Facebook Messenger, Instagram DMs, and WhatsApp), order management, and payment routing via Stripe Connect. Botique is a platform and tooling provider — you remain the seller of record for every order placed through your Botique storefront or chat assistant.

4. Your responsibilities

  • Fulfil orders you accept and communicate clearly with your customers.
  • Only list items you are legally permitted to sell and for which you have rights.
  • Comply with consumer-protection, tax, and data-protection laws in the jurisdictions you operate in.
  • Comply with Meta’s Platform Terms and the Messenger, Instagram, and WhatsApp Business policies when using the chat assistant on those channels.
  • Comply with Stripe’s Connected Account Agreement for card payments.

5. Prohibited use

You may not use Botique to:

  • Sell items prohibited by law, Stripe, or Meta (including drugs, weapons, counterfeit goods).
  • Send spam or unsolicited marketing messages via any Messenger, Instagram, or WhatsApp integration.
  • Attempt to breach platform security, scrape other tenants’ data, or reverse-engineer the Service.
  • Impersonate another business or misrepresent your identity.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

6. Fees and billing

Subscription fees are billed monthly in advance. You authorise us to charge your payment method on each renewal. Fees are non-refundable except as required by law or at our sole discretion. If payment fails, we may suspend your account until payment is restored.

Stripe’s own processing fees apply to card transactions and are paid directly to Stripe. Botique does not take a percentage of your sales.

7. Your content

You retain ownership of the products, images, descriptions, and other content you upload. You grant Botique a non-exclusive licence to host, process, and display that content for the purpose of operating your storefront and bot. You confirm you have the right to upload and use this content.

8. Service availability

We work hard to keep Botique available but do not guarantee uninterrupted service. Third-party outages (Meta, Stripe, Supabase, Vercel) may affect the Service. We are not liable for losses resulting from downtime outside our reasonable control.

9. Limitation of liability

To the fullest extent permitted by law, Botique’s total liability to you for any claim arising out of or relating to the Service is limited to the fees you paid Botique in the 12 months before the claim arose. Botique is not liable for indirect, incidental, or consequential damages, including lost profits or loss of data.

10. Termination

You may cancel your subscription at any time from your dashboard. We may terminate or suspend your account for breach of these terms or for legal reasons. On termination, your storefront will be taken offline and your data will be deleted after 30 days.

11. Changes to these terms

We may update these terms from time to time. Material changes will be announced to active accounts by email at least 14 days before they take effect. Continued use of Botique after changes take effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of New Zealand. Any dispute will be resolved in the courts of New Zealand, without prejudice to any mandatory consumer-protection rights you may have in your own jurisdiction.
